PUC Clarifies Application of New Rules to Consumer Complaints

HARRISBURG– The Pennsylvania Public Utility Commission (PUC) today finalized a policy statement that clarified the role of consumers as parties to cases pending before the Commission.

“The Commission’s rules should be interpreted to maximize the opportunity for the public to file formal complaints and participate in the Commission’s proceedings at whatever level they desire,” said Commission Chairman Wendell F. Holland. “The obligations related to fully participating in a complex case may be daunting for most consumers, but those consumers should still have every opportunity to participate at whatever level they feel comfortable.”

The Commission voted 4-0 to approve the policy statement that the Commission supports case management practices that would allow parties some form of limited participation in complex multi-party proceedings. Also, the status of a consumer complaint in the case should not affect the consumer’s ability to testify at the public input hearings scheduled in the case. The testimony presented at public input hearings may be used by the parties to support their positions.

On April 29, 2006, revisions to the Commission’s rules of practice and procedure went into effect. The revisions were designed to reflect significant changes in the PUC’s jurisdiction and responsibilities.  The Commission’s final rules of practice and procedure struck a balance for utilities, consumers and the public without imposing unnecessary delays, burdens or costs.  The rules also struck a balance between proceedings where the parties are represented by attorneys and proceedings where the parties represent themselves. 

Concerns were raised about some interpretations of the changes, specifically as applied to individual consumer complaints. On Sept. 15, 2006, the Commission issued a draft policy statement clarifying its position on the changes and seeking comments from interested parties.
