PUC Approves Settlement that Fines a Philadelphia Limousine Company $1,000 for a Violation

HARRISBURG – The Public Utility Commission (PUC) today approved a settlement between the PUC’s Bureau of Transportation and Safety and Big Time’s Night Train, a limousine company from Philadelphia.  The settlement agreement has the company paying a $1,000 civil penalty for failure to maintain evidence of insurance on file with the Commission.

On Dec. 8, 2006, the Commission’s Bureau of Transportation and Safety filed a complaint alleging that the company transported persons in a limousine during a 10-week period when the company’s operating rights were suspended due to failure to maintain evidence of insurance on file with the Commission. The PUC alleged that the company had performed 101 trips within Pennsylvania during their suspension from July 7, 2006, through Sept. 20, 2006.  The PUC recommended a civil penalty of $42,000.

In February 2007, Big Time’s Night Train certified through their insurance company that they had insurance during the suspension.  The company admitted that they had failed to provide evidence of the insurance to the Commission, and requested a reduction in the amount of the penalty.

The PUC’s Bureau of Transportation and Safety and Big Time’s Night Train filed a settlement agreement in June 2007 that reduces the penalty to $1,000.  The company also admitted that they performed 101 trips within Pennsylvania during the period its operating rights were suspended due to its failure to maintain evidence of insurance on file with the Commission.  The company also agreed to cease and desist from all further violations of the Public Utility Code or Commission regulations.
