PUC Fines Allegheny County Man for Providing Transportation Service Without Certification

HARRISBURG – The Pennsylvania Public Utility Commission (PUC) today fined Donald E. Bailey of Bethel Park $10,000 for offering to provide service without Commission approval.

On Oct. 16, 2006, the PUC’s Bureau of Transportation and Safety filed a complaint against Bailey alleging that he transported persons for compensation while not then holding a certification of public convenience issued by the Commission.

After mail to Bailey was returned as “unable to forward,” the PUC then published the complaint and notice in the Pennsylvania Bulletin.  The PUC did not receive a response during the 20 day response period so the complaint and fine area sustained. Bailey also is ordered to cease and desist from all further violations of the Public Utility Code or Commission regulations.

It is unlawful to transport any passenger for compensation without holding a PUC certificate of public convenience. The PUC issues certificates for the transportation of passengers and property between points in the state.  Passenger certificates are issued for taxi, limousine, van and bus service. 

Holding a certificate of public convenience ensures that the company has met all of the PUC’s safety and insurance standards. The PUC monitors certificated carriers for insurance coverage, driver and vehicle safety, rates, territory and service.

Certificated taxis and vans are required to display their company name and PUC identification number in 2-inch-high block lettering on both sides of the vehicle.  Other than limousines, a vehicle without these markings is not a PUC licensed vehicle, and consumers should not use the vehicle.
