PUC Begins Review of Existing Railroad Transportation Regulations

HARRISBURG – The Pennsylvania Public Utility Commission (PUC) today began a review of the Commission’s existing railroad transportation regulations.

“These regulations, originally adopted in 1945, have not undergone a comprehensive revision since 1975,” said Commissioner Kim Pizzingrilli in a motion to initiate the review. “Many of these regulations appear to be obsolete, unenforceable or superseded by federal law or regulations. It is critical that our regulations reflect the technological and operational changes of the railroad industry that have occurred over the last 30 years and to reflect current federal standards.”

The Commission voted 4-0 to approve the motion to undertake the review and solicit opinions from affected stakeholders. The goal is to streamline the regulations to make certain the Commission can continue to ensure safe and reliable service.

Consideration will be given to ensure that the regulations:

  • Address a compelling public interest;
  • The costs of regulation do not outweigh the benefits;
  • Are written in a clear and concise manner; and
  • Where federal regulations exist, the PUC regulations should not exceed federal standards unless justified by a compelling Pennsylvania interest or required by state law.

A staff recommendation and proposed rulemaking to update the regulations will be provided for Commission consideration within six months. The Commission may formally begin the rulemaking process from there.

The Pennsylvania Public Utility Commission balances the needs of consumers and utilities to ensure safe and reliable utility service at reasonable rates; protect the public interest; educate consumers to make independent and informed utility choices; further economic development; and foster new technologies and competitive markets in an environmentally sound manner.
