PUC Adopts Final Rulemaking to Bring Safety Regulations in Line with Federal Pipeline Safety Program

HARRISBURG – The Pennsylvania Public Utility Commission (PUC) today finalized rulemaking that adopts applicable federal regulations and brings its safety regulations in line with the Federal Pipeline Safety Program.

The Commission voted 5-0 to adopt the federal regulations for the transportation of hazardous materials and liquid fuels by pipeline.

Pennsylvania currently exercises jurisdiction over petroleum and oil pipeline utilities. The Commission also has jurisdiction over hazardous materials and liquid fuels transported via pipeline or conduit to the public for compensation.  However, no specific regulations are in place to effectively address enforcement and safety issues.  This rulemaking will close this gap.

The U.S. Department of Transportation’s Pipeline and Hazardous Materials Safety Administration’s Hazardous Liquid Pipeline Safety Grant Program supports efforts to develop and maintain state natural gas, liquefied natural gas and hazardous liquid pipeline safety programs. Pennsylvania participates in the performance-based program and funding is allocated based upon the degree to which a state has met specific measures. The final language change increases the state’s compliance with these measures and is separate from the authority given to the Commission under Act 127 of 2011 which requires the Commission to enforce the federal pipeline safety laws over non-public utility pipelines transporting natural gas and hazardous liquids.

Final regulations will become effective upon publication in the Pennsylvania Bulletin.

The Pennsylvania Public Utility Commission balances the needs of consumers and utilities to ensure safe and reliable utility service at reasonable rates; protect the public interest; educate consumers to make independent and informed utility choices; further economic development; and foster new technologies and competitive markets in an environmentally sound manner.
