PUC Fines 28 Transportation Companies for Failure to Pay Assessment Balances

HARRISBURG – The Pennsylvania Public Utility Commission (PUC) today voted to fine 28 transportation companies for failure to file an assessment report demonstrating their gross intrastate operating revenues for the 2010, 2011 and 2012 calendar years.

The Commission voted unanimously to fine all 28 companies and revoke their certificates, prohibiting them from operating in Pennsylvania if they fail to pay the fine and file reports for the years in which they failed to file.

Operators who face $3,000 fines for failing to file an assessment report for the 2010, 2011 and 2012 calendar years include:

• Christopher M. Fish (Lycoming County)
• Jack A. Lenker Inc. (Cumberland County)
• R. H. Kuhn Co. Inc. (Allegheny County)
• Friends Towing Inc. (Montgomery County)
• Anthony S. Pileggi, Frank Pileggi and James Pileggi (Montgomery County)
• JBJ Enterprises Inc. T/A TBJ Trucking (Lawrence County)
• Jeffrey Allen Dillinger (Fayette County)
• Transportation Solutions Inc. (Allegheny County)
• The Eagle’s Nest Inc. (New Castle County, Del.)
• Trinity Transport Inc. (Lancaster County)
• Over the Top Heavy Hauling LLP (Bradford County)
• Sones Transport Inc. (Centre County)
• Milro Services Inc. (Garrett County, Md.)
• Bobby Wholesale Distributor Inc. (Philadelphia County)
• Siemens Water Technologies Transport Corp (St. Joseph County, Ind.)
• CHKE Towing Inc. T/A Rick’s Towing Service (Allegheny County)

Operators who face $2,000 fines for failing to file an assessment report for the 2011 and 2012 calendar years include:

• Shanahan Transfer & Storage Co. (Allegheny County)
• Southern Blair Emergency Medical Service Inc. (Blair County)
• Gary A. Ladigan T/A Gary A. Ladigan Trucking (Lehigh County)

Under the Public Utility Code, the Commission is funded by assessments of regulated utilities. The Code also authorizes the Commission to impose civil penalties on utilities for violations of the Public Utility Code and PUC regulations. The companies subject to today’s actions failed to respond to the PUC’s requests to bring their assessment reports up-to-date and in line with the Public Utility Code.
