PUC Fines 10 Companies for Failure to Pay Assessment Balances

HARRISBURG – The Pennsylvania Public Utility Commission (PUC) today voted to fine ten transportation companies for failure to file an assessment report demonstrating their gross intrastate operating revenues for the 2010, 2011 and 2012 calendar years.

The Commission voted unanimously to fine all ten companies and revoke their certificates, prohibiting them from operating in Pennsylvania if they fail to pay the fine and file reports for the years in which they failed to file.

Transportation operators who face $3,000 fines for failing to file an assessment report for the 2010, 2011 and 2012 calendar years include:

• Scott A. Adam (Montgomery County)
• Kulick Trucking (Lackawanna County)
• Affinity Logistics Corp. (Dauphin County)
• Sitton Motor Lines Inc. (Allegheny County)
• Velocity Express Leasing Inc. (Allegheny County)
• Lisa A. Kelly (Berks County)
• Karemer-Casey Enterprises Inc.(Dauphin County)

Two operators, Soumare Inc. (Philadelphia County) and Foredul Trans Inc. (Philadelphia County), face a $2,000 fine for failing to file an assessment report for the 2011 and 2012 calendar years.

Three operators also face fines for not filing their assessment amounts for Fiscal Year 2013-14:

• Micky Cab Corp. - $1,309 (Philadelphia County)
• Scott F. Stout - $347 (Lancaster County)
• Laobina Inc. - $3,050 (Philadelphia County)
• Robert G. Sprout - $2,041 (Dauphin County)

Under the Public Utility Code, the Commission is funded by assessments of regulated utilities. The Code also authorizes the Commission to impose civil penalties on utilities for violations of the Public Utility Code and PUC regulations. The companies subject to today’s actions failed to respond to the PUC’s requests to bring their assessment reports up-to-date and in line with the Public Utility Code.
