PUC Approves Default Judgment Against Former Pittsburgh Moving Company Operator Regarding Unpaid Assessments & Fines

HARRISBURG – The Pennsylvania Public Utility Commission (PUC) today approved a Motion for Default Judgment against the former operator of a Pittsburgh moving company accused of failing to file a required assessment report for calendar year 2011 and failing to pay the required assessment for the 2012-2013 fiscal year.

The Commission voted 5-0 to order that William T. Malloy, who had operated from a Pittsburgh address as “Are You Moving,” pay $1,025 for the required assessment and related civil penalties within 30 days.

If payment is not received during that period the matter will be referred to the Pennsylvania Office of Attorney General for appropriate action. Additionally, the Commission will forward a copy of the order to the Pennsylvania Department of Transportation with a request that Mr. Malloy and his business be prevented from registering any new vehicles or renewing any existing vehicle registrations until all past due amounts are paid.

In January 2015 the Commission moved to transfer all of rights for Malloy/Are You Moving to operate as a motor carrier in Pennsylvania to a separate company.  At that time, the PUC Certificate of Public Convenience issued to Malloy/Are You Moving was canceled and all rights to operate in Pennsylvania were terminated. 

Under the Public Utility Code, the Commission is funded by assessments of regulated utilities. The Code also authorizes the Commission to impose civil penalties on utilities for violations of the Public Utility Code and PUC regulations.

Malloy and his moving company are accused of failing to respond to the PUC’s requests to bring their assessment reports up-to-date and in line with the Public Utility Code and failing to pay outstanding assessment balances and fines.
