PUC Issues Default Judgment Against Erie Yellow Cab Regarding Unpaid Assessments & Fines

HARRISBURG – The Pennsylvania Public Utility Commission (PUC) today approved a Motion for Default Judgment against Erie Transportation Services Inc., operating as Erie Yellow Cab, accused of failing to pay an outstanding balance on its required assessment for the 2014-2015 fiscal year, along with civil penalties.
The Commission voted 5-0 to order the company to pay $10,031 within 30 days.
If payment is not received during that period, the PUC’s Bureau of Technical Utility Services shall cancel the Certificate of Public Convenience held by Erie Transportation Services. Additionally, the matter will be referred to the Pennsylvania Office of Attorney General for appropriate action and the Commission will forward a copy of the order to the Pennsylvania Department of Transportation, with a request that the business be prevented from registering any new vehicles or renewing any existing vehicle registrations until all past due amounts are paid.
Under the Public Utility Code, the Commission is funded by assessments of regulated utilities. The Code also authorizes the Commission to impose civil penalties on utilities for violations of the Public Utility Code and PUC regulations.
On Aug. 14, 2015 the PUC’s Bureau of Investigation and Enforcement (I&E) filed a complaint against Erie Transportation Services, Inc., for failure to pay an outstanding 2014-2015 assessment balance of $19,157. At the time, I&E also recommended a civil penalty of $2,874. The company did not answer the complaint, but in January 2016 submitted partial payment of $12,000. Since that time, there have been no further responses or payments from the company.
