PUC Approves $25,000 Settlement Regarding Unlicensed Power Broker

HARRISBURG – The Pennsylvania Public Utility Commission (PUC) today approved a settlement with Fair View Energy, Inc., based in Fairview, Erie County, resolving allegations that the company acted as a broker or marketer of electric energy without being properly licensed by the PUC.

The Commission voted 4-1 to approve the Joint Petition for Settlement, which was submitted by Fair View Energy and the Commission’s independent Bureau of Investigation and Enforcement (I&E).

Under the terms of the settlement approved today, Fair View Energy acknowledged the seriousness of the allegations and recognized the need to prevent the reoccurrence of unlicensed electric generation supply (EGS) brokering activities. Fair View will pay a total civil penalty of $25,000, payable to the Commonwealth of Pennsylvania, along with $350, related to the annual fee for serving as an EGS broker during the 2015 calendar year.

Additionally, the Commission voted 5-0 to approve a license application for Fair View to serve as an EGS broker/marketer. As part of the settlement, I&E supported the expedited treatment of Fair View’s license application proceeding.

The Pennsylvania Public Utility Commission balances the needs of consumers and utilities; ensures safe and reliable utility service at reasonable rates; protects the public interest; educates consumers to make independent and informed utility choices; furthers economic development; and fosters new technologies and competitive markets in an environmentally sound manner.
