PUC Issues Proposed Rulemaking for Rail Industry

HARRISBURG – The Pennsylvania Public Utility Commission (PUC) today issued for comment a proposed rulemaking reflecting the recent technological and operational changes of the railroad industry.
The Commission voted 5-0 to issue for comment the proposed rulemaking which takes into consideration the technological and operational changes of the rail industry over the last thirty years and reflects current Federal standards. While drafting the rulemaking, consideration was given to ensure that the regulations:
- Address a compelling public interest;
- The costs of regulation do not outweigh the benefits;
- Are written in a clear and concise manner; and
- Where Federal regulations exist, the PUC regulations should not exceed federal standards unless justified by a compelling Pennsylvania interest or required by state law.
On Nov. 6, 2009, the Commission voted to approve a motion to undertake the review of the regulations and solicit opinions from affected stakeholders. The goal is to streamline the regulations to make certain the Commission can continue to ensure safe and reliable service.
The Pennsylvania Public Utility Commission balances the needs of consumers and utilities to ensure safe and reliable utility service at reasonable rates; protect the public interest; educate consumers to make independent and informed utility choices; further economic development; and foster new technologies and competitive markets in an environmentally sound manner.
