PUC Cancels Public Input Hearings in Pentex Pipeline Co. Application to Become a Public Utility in Bradford County, Schedules Hearings for October

HARRISBURG – Due to concerns for safety following the flooding throughout Pennsylvania, the state Public Utility Commission (PUC) today has canceled two hearings scheduled for Sept. 13, 2011, to receive public comment on the proposal by Pentex Pipeline Co. to become a public utility under the Public Utility Code. Public input hearings on the matter will be held in October.

“The essence of a public input hearing is to afford the public an opportunity to comment and to be heard,” the Commission Order canceling the hearing said. “The request to cancel the public input hearing of the 13th, while driven by unfortunate circumstances, makes sense, as recovery efforts from the effects of Tropical Storm Lee are only in their initial stages and it would be difficult, and possibly dangerous, for members of the public to attend a hearing on Sept. 13, 2011.”

Administrative Law Judge (ALJ) Dennis J. Buckley will hold hearings on the case at:

1 p.m. and 6 p.m. Oct. 7, 2011

On March 8, 2011, Pentex Pipeline filed for a certificate of public convenience to begin to offer gathering and transporting or conveying service by pipeline to the public in the Townships of Wyalusing, Herrick, Terry, Tuscarora, Stevens and Wilmot in Bradford County. Subsequently, Pentex amended its Application to include the Borough of Wyalusing in its Application.  The company has applied to be a public utility under the Public Utility Code, Title 66 of Pennsylvania's Consolidated Statues.
