PUC Approves $1,000 Settlement with Centre County Property Carrier Service for Violations

HARRISBURG – The Pennsylvania Public Utility Commission (PUC) today finalized a settlement with Maxwell Transport Inc. for violations of the Public Utility Code and Commission regulations.  

The Commission voted 5-0 to adopt the proposed settlement, which fines the company $1,000 for several violations.

Pursuant to enforcement responsibilities and based on its finding from a safety audit, the Commission’s Bureau of Transportation and Safety initiated a complaint against the company for:

  • permitting its drivers to operate for more than 11 consecutive hours without the mandatory off-duty period on nine occasions;
  • permitting its drivers on seven occasions to drive after having been on duty for 14 hours;
  • permitting its drivers to prepare a false record of duty status on three occasions;
  • failing to require a driver on one occasion to prepare a record of duty status;
  • failing to maintain completed driver qualification files for three of its drivers that contain annual reviews, annual certification of violations and a current copy of the driver’s license on file;
  • failing to retain copies of roadside driver/vehicle inspection reports of 12 months; and
  • failing to ensure, on three occasions, that its drivers complete Record of Duty status reports.

Maxwell Transportation Inc. is a common carrier of property and is licensed in Centre County.
