PUC Fines 14 Companies for Failure to Pay Assessment Balances

HARRISBURG – The Pennsylvania Public Utility Commission (PUC) today voted to fine 12 transportation companies and two telecommunications companies for failure to file an assessment report demonstrating their gross intrastate operating revenues for the 2010, 2011 and 2012 calendar years.

The Commission voted unanimously to fine all 14 companies and revoke their certificates, prohibiting them from operating in Pennsylvania if they fail to pay the fine and file reports for the years in which they failed to file.

Transportation operators who face $3,000 fines for failing to file an assessment report for the 2010, 2011 and 2012 calendar years include:

• Penn Eastern Rail Lines Inc. (Allegheny County)
• Saini Express Inc. (Dauphin County)
• Apollo Trade & Transport Inc. (Mahoning County, Ohio)
• J.C.H. & S. Marchese T/A Marchese Brothers (Montgomery County)
• Donald Elwood Dorr T/A Wilkinsburg Moving Exchange (Allegheny County)
• C-Line Inc. (Fairfield County, Conn.)
• 20th Century Refuse Removal Co. (Philadelphia County)
• Four Star Transportation Co. (Wayne County, Mich.)
• TNT Services Corp. (Susquehanna County)
• Charles S. Novosel (McKean County)
• Jadell Minniefield Construction Services Inc. (Allegheny County)

One operator, Eagle Transportation Services Inc. (New Castle County, Del.), faces a $2,000 fine for failing to file an assessment report for the 2011 and 2012 calendar years.

Telecommunications operators who face $3,000 fines for failing to file an assessment report for the 2010, 2011 and 2012 calendar years include:

• Worldnet Communications Inc. T/A TMS (Onondaga County, N.Y.)
• Talkspan Inc. (Fulton County, Ga.)

Under the Public Utility Code, the Commission is funded by assessments of regulated utilities. The Code also authorizes the Commission to impose civil penalties on utilities for violations of the Public Utility Code and PUC regulations. The companies subject to today’s actions failed to respond to the PUC’s requests to bring their assessment reports up-to-date and in line with the Public Utility Code.
