PUC Issues Default Judgments Regarding Unpaid Assessments & Fines by Transportation Companies from Lancaster County and Utah

HARRISBURG – The Pennsylvania Public Utility Commission (PUC) today approved two Motions for Default Judgment involving transportation companies accused of failing to pay outstanding balances on their required assessments, along with civil penalties.

The Commission voted 5-0 to order the companies to make full payment within 30 days of the matters will be referred to the Pennsylvania Office of Attorney General for appropriate action.

Ronald L. Hershey, trading as Action Courier Team Service, of Willow Street, Lancaster County, was ordered to pay a total of $1,149. This amount includes an outstanding assessment balance of $119, for the 2014-15 Fiscal Year, along with a civil penalty of $1030 for failure to pay the assessment and failure to file the required annual assessment report.

Hooters Hotshot, Inc., based in Vernal, Utah, was ordered to pay a total of $2,681. This amount includes an outstanding assessment balance of $1,462, for the 2013-14 and 2014-15 Fiscal Years, along with a civil penalty of $1,219, for failure to pay the assessments and failure to file the required annual assessment report.

Under the Public Utility Code, the Commission is funded by assessments of regulated utilities. The Code also authorizes the Commission to impose civil penalties on utilities for violations of the Public Utility Code and PUC regulations.

The PUC’s Certificates of Public Convenience, which allowed both companies to legally operate in Pennsylvania, were previously cancelled for failure to maintain evidence of required insurance with the Commission.
