Supplier Application & Resources

Entities that want to operate in the Commonwealth of Pennsylvania’s retail electric market and that meet the definition of an EGS must be licensed by the Pennsylvania Public Utility Commission.  In Pennsylvania, all entities, including Supplier/Aggregators (hereinafter EGS - Suppliers) and Broker/Marketers (hereinafter EGS - Brokers), are licensed as Electric Generation Suppliers.

Notice for Electric Suppliers

Suppliers should send their electric choice annual or quarterly reports by overnight delivery to the Commission’s street address (not the post office box):

This is in accordance with the Commission’s Secretarial Letter concerning reports filed under  52 Pa Code §§ 54.203, 54.39, 54.40(a), and 62.110 issued July 27, 2020, modifying the Commission’s Emergency Order at Docket Number M-2020-3019362 which has been featured on our COVID-19 page since the date of issuance.  You are instructed to retain your mailing’s tracking information as proof of your submittal.  Currently, the Commission receives mail delivery ONE day per week and staff of the Secretary’s Bureau usually visits our offices twice a week in an effort to coordinate with mail delivery.  Sometimes this is not possible, and staff will receive and process fillings when they are permitted to enter our offices. 

However, the Commission’s regulations allow us to give your filing the date you deposited it in overnight delivery, certified mail, or priority mail as the date of filing - regardless when the Commission receives the filing physically in our offices.  Emailing these reports to the Secretary does not change the filing date because the date of deposit will become the stamped in filing date. Therefore, emailing the reports to the Secretary only causes duplication and confusion.  Your tracking information is important for you to retain in the event your package does not arrive.

Definitions

EGS - A person or corporation, including municipal corporations which choose to provide service outside their municipal limits except to the extent provided prior to the effective date of this chapter (66 Pa. C.S. Chapter 28), brokers and marketers, aggregators or any other entities, that sells to end-use customers electricity or related services utilizing the jurisdictional transmission or distribution facilities of an electric distribution company or that purchases, brokers, arranges or markets electricity or related services for sale to end-use customers utilizing the jurisdictional transmission and distribution facilities of an electric distribution company.  The term excludes building or facility owner/operators that manage the internal distribution system serving such building or facility and that supply electric power and other related power services to occupants of the building or facility.  The term excludes electric cooperative corporations except as provided in 15 Pa. C.S. Ch. 74 (relating to generation choice for customers of electric cooperatives).

Aggregator or Market Aggregator:  An entity, licensed by the Commission, that purchases electric energy and takes title to electric energy as an intermediary for sale to retail customers.

Broker or Marketer:  An entity, licensed by the Commission, that acts as an agent or intermediary in the sale and purchase of electric energy but that does not take title to electric energy.

Electric Generation Supplier Application

The Public Utility Code authorizes the PUC to collect an annual fee of $350 from each licensed / certified supplier, broker, marketer and aggregator of electricity and natural gas approved to do business in the Commonwealth of Pennsylvania. In addition, an annual supplemental fee based on reported annual gross intrastate operating revenues will be applicable to suppliers of electricity and natural gas.

Certificate of Service

EGS Certificate of Service (Template) – Electric Generation Suppliers are required to provide service of all filings to the five statutory agencies as well as all EDCs in which the EGS operates.  However, only NON-CONFIDENTIAL information must be provided to any entity other than the Secretary of the PUC at the above address. (Required for EGS Suppliers and EGS Brokers.)

Financial Security

EGS Financial Security

EGS Financial Security – Electric Generation Suppliers are required to maintain a financial security instrument the entire time it maintains an EGS license with the Commonwealth of Pennsylvania. (Required for EGS Suppliers and EGS Brokers.)

If a licensed EGS fails to file the required financial security at least 30 days prior to the expiration date of its financial security, it may cause Commission staff to initiate a formal proceeding that may lead to cancellation of the EGS’s license, fines and penalties, removal of the company’s information from the Commission’s website, and notification toall electric distribution companies in which the EGS is licensed to do business.

  • EGS - Broker/Marketers: Unless ordered by the Commission, an EGS - Broker licensee is required to maintain a security level of $10,000.
  • EGS - Supplier/Aggregator: The Commission's regulations at 52 Pa. Code §54.40(d) require the security level, or bond amount, for each EGS – Supplier licensee to be the greater of 10% (or 5%, from Security Reduction Petition Approval) of the licensee's most recent reported 4 quarters of gross receipts or $250,000. 

90 Day Renewal Notification Letter (Sample)

90 Day Renewal Notification Letter (Sample) – A Secretarial Letter that is sent out by the Commission to notify EGSs (includes Supplier/Aggregator and Broker/Marketers) of the impending expiration date of its current financial security instrument. The Letter is also a notification to EGS - Suppliers of a possible need to increase the financial security.

Bond (Fixed-Term Template)

Bond (Fixed-Term Template) – A template of the language required to use a Bond as a financial security instrument.  This bond expires every year and must be renewed.  EGS - Suppliers may need to adjust the amount based on the EGS - Supplier’s reported gross receipts.  Bond renewals do not require a Certificate of Service (above).

Bond (Continuous Template)

Bond (Continuous Template) – A template of the language required to use a Bond as a financial security instrument.  This bond does not expire every year. EGS - Suppliers may need to adjust the amount based on the EGS - Supplier’s reported gross receipts.  Bond renewals do not require a Certificate of Service (above).

Letter of Credit (Continuous Template)

Letter of Credit (Continuous Template) – A template of the language required to use a Letter of Credit as a financial security instrument.  This Letter of Credit does not expire every year. EGS - Suppliers may need to adjust the amount based on the EGS - Supplier’s reported gross receipts.  Letter of Credit renewals do not require a Certificate of Service (above).

Parental/Corporate Guarantee Petition

EGS Supplier and/or EGS Broker may file a petition to use a Parental/Corporate Guarantee as its financial security instrument.  The petition must be approved by the Commission prior to the entity filing a fully executed Parental/Corporate Guarantee.

Financial Security Reduction Petition

EGS Suppliers (NOT EGS Brokers) that have operated as an EGS in Pennsylvania for at least two years may petition for a reduction in financial security level from the greater of $250,000 or 10% of Gross Receipts down to the greater of $250,000 or 5% of Gross Receipts. The petition must be approved by the Commission with a Secretarial Letter prior to the submission of a financial security instrument at the 5% level of Gross Receipts. A Certificate of Service (above) is required for this filing.

Checklist for Financial Security Reduction Petition

Checklist for Financial Security Reduction Petition – This checklist contains the basic information and requirements for submitting a petition to reduce an EGS Supplier’s financial security to the greater of $250,000 or 5% of Gross Receipts. If approved, a Financial Security Reduction Annual Compliance Filing is required annually to renew the approved reduction. The Financial Security Reduction Annual Compliance Filing must be filed 90 days prior to the approved EGS's current security expiration or anniversary date. A Certificate of Service (above) is required for this filing.

Financial Security Reduction Renewal

An EGS Supplier (NOT EGS Broker) with a previously approved Financial Security Reduction may file an Annual Compliance Filing to renew its currently approved 5% financial security instrument level from the greater of $250,000 or 5% of Gross Receipts. A Certificate of Service (above) is required for this filing.

Checklist for Financial Security Reduction Annual Compliance Filing This checklist contains the basic information and requirements for submitting an Annual Compliance Filing requesting to renew an EGS Supplier’s Commission approved Financial Security Reduction.  The Annual Compliance Filing is required annually, and it should be filed 90 days before the current financial security expiration or anniversary date.  A Certificate of Service (above) is required for this filing.

Tax Status Letter (PA Department of Revenue)

Tax Status Letter (PA Department of Revenue) – A current letter from the Pennsylvania Department of Revenue is required for the Initial Petition as well as each renewal of the EGS – Supplier’s Financial Security Reduction.  Required annually, and it should be filed 90 days before the current security expires to ensure the reduction does not expire.
